Lagos Assembly Leadership Tussle: Court Adjourns Case to March 10 for Pending Applications

A Lagos State High Court in Ikeja has adjourned the case challenging the removal of Hon. Mudashiru Obasa as Speaker of the Lagos State House of Assembly (LSHA) to Monday, March 10, for the hearing of all new and pending applications.
During Friday’s hearing, Justice Yetunde Pinheiro directed all involved parties to file and serve all necessary legal documents ahead of the next session to facilitate a fair hearing.
Among the pending applications, the Deputy Speaker and 36 lawmakers have urged the court to dismiss or strike out the case, arguing that the matter has become an academic exercise.
Additionally, two new lawyers, Olusola Idowu (SAN) and Clement Onwuenwunor, have joined the case, representing some lawmakers and filing fresh applications.
After considering arguments from all counsels, Justice Pinheiro adjourned proceedings, stating that the postponement serves the interest of justice.
Speaking outside the courtroom, Obasa’s lawyer, Afolabi Fashanu (SAN), explained that his client is contesting not only the legality of his removal but also the allegations leveled against him, including fraud, high-handedness, abuse of office, and gross misconduct. He stressed that Obasa was not given a fair hearing before his removal.
On the other side, lawyer Romeo Michael, representing 34 lawmakers recently added to the suit, stated that they have filed a counterclaim asking the court to uphold Obasa’s removal as constitutional and in line with Section 92 of the 1999 Nigerian Constitution.
The court is set to hear these arguments on March 10, as the legal battle over the leadership of the Lagos Assembly continues.
